9. Responsibilities of the Data Controller, Data Processor, and Joint Controllers
9.1. Depending on the context and purpose of processing, Flip Flat may act as a data processor on behalf of the data controller.
9.1.1. Ensure individuals involved in data processing are obligated to maintain confidentiality.
9.1.2. Protect data in compliance with legal requirements, including implementing appropriate technical and organizational measures to safeguard information containing personal data against accidental or unlawful destruction, alteration, disclosure, acquisition, damage, any other unauthorized or unlawful use, or accidental or unlawful loss.
9.1.3. Maintain records of all actions performed with electronic data (including incidents, collection, modification, access, disclosure (transfer), communication, and deletion of information) and ensure accountability for these actions. For non-electronic data, the processor must record all disclosure and/or alteration activities (including incidents).
9.1.4. Respond promptly to inquiries from regulatory and other authorized bodies regarding data processing issues and fulfill obligations to ensure data subjects’ rights (blocking, deletion, rectification, updating, etc.) within the timeframes prescribed by Georgian personal data protection law.
9.1.5. Do not transfer the right to process data to other entities without the consent of the data controller.
9.1.6. In case of a dispute between the data controller and the processor regarding data processing, the processor must immediately cease processing and transfer all data to the controller.
9.1.7. Upon request by the data controller or contract termination, the processor must cease processing and, within 10 (ten) calendar days, transfer all personal data and delete or destroy it unless retention is required by law.
9.1.8. Issues not covered by this policy are regulated by Georgian legislation on personal data protection.
